Trump’s Push to Reshape the 2026 Election

New Insider podcast featuring Kate Shaw

A NOTE FROM THE PRODUCER

Claudia Hernández is the Producer of the Insider podcast.

The Trump administration is asking the Supreme Court to allow new restrictions on mail-in voting to take effect ahead of the midterm elections, after a federal judge blocked the effort. The case could affect millions of mail-in voters and raises questions about the president’s authority over federal elections.

On a new episode of the Insider podcast, Joyce Vance is joined by constitutional scholar and Strict Scrutiny podcast host Kate Shaw, while Preet is out.

As Kate explains, the Trump administration is taking the unusual step of trying to bypass the ordinary appeals process and go directly to the Supreme Court. On what basis?

Kate: “Here the alleged emergency is the president’s inability to implement a clearly unlawful, unconstitutional executive order that would both assert unprecedented federal authority over elections and also inject a really stunning degree of uncertainty and likely disenfranchisement into the upcoming election.”

Joyce: “The argument is that the administration’s interests outweigh the rights of voters.”

Typically, the Supreme Court would not even entertain such a request without a robust appellate process, but, as Kate further explains: “The Supreme Court’s repeated granting of these emergency applications has incentivized the Solicitor General’s repeated requests for more.”

How will this case play out? Listen to the episode to hear more of Kate and Joyce’s analysis, and comment below with your thoughts and questions.
