Can ICE use racial profiling to make immigration stops?
In a new episode of the Insider podcast, Preet Bharara and Joyce Vance discuss the Supreme Court’s latest immigration ruling, which loosened restrictions on raids in Los Angeles to allow ICE to make immigration stops based on factors like ethnicity. As Joyce explains on the show, this decision could open the door to a revival of “papers, please” laws that require individuals to carry immigration documents and present them to law enforcement upon request.
Joyce: “In some parts of the country, it’s not a terrible idea [to carry your papers], which is a really sad commentary on where we are. But the Supreme Court had a busy Monday. And one of the things that they did was they, in essence, legitimized the use of the color of your skin, your accent, the kind of job you’re perceived as having as factors that can be used in whether or not to detain you on potential suspicion of immigration violations.”
