On a new episode of the Insider podcast, Joyce Vance is joined by constitutional law professor Leah Litman to examine what made the Supreme Court’s latest term so consequential.
Litman argues that the term’s central theme is how the Court’s conservative majority is reshaping the balance of power between the branches of government, away from Congress and towards the judiciary and the executive: “The Court’s continued pattern of giving the president more power while incapacitating Congress and at the same time empowering themselves is…a fundamental reallocation of the separation of powers.”
Citing the Court’s rulings on campaign finance and the president’s ability to fire the heads of independent agencies, Litman says many recent decisions are best understood as reflecting the Republican Party’s long-standing priorities rather than simply benefiting President Trump: “The things that the Supreme Court is doing to enable corruption, like unleashing more money in politics or handing the president more power over these previously independent agencies, those are all things that the median member of the Republican Party really wants to do and has wanted to do for a really long time.”
